Wills and succession agreements

The Will shall contain the testator's wishes regarding how their assets will be distributed after their death, following legal guidelines that reflect those intentions, with prior notarial advice. It can also include other decisions such as the acknowledgment of children, etc. This act can be modified at any point in life, as it is fundamentally revocable, allowing changes as desired. The last validly executed Will shall always prevail.

In the absence of a will, when a person passes away, the Notary appoints the heirs according to the applicable common or local law, which is a preliminary step before the potential distribution of the inheritance among the successors.

Documentation: ID card (DNI), Foreigner Identification Number (NIE), or passport of the requester, death certificate, last will and testament, Family Book or birth and marriage certificates, among others. Two witnesses are required."

This deed will determine the distribution of assets and fortune among the heirs according to the provisions outlined in the will or the intestate declaration

The acceptance of an inheritance typically requires agreement from all the heirs. In the event of a lack of agreement, one heir can request others to express their intention to accept or renounce the inheritance, as regulated in the current Article 1005 of our existing Civil Code. This process is a preliminary step and does not replace the need to formalize the deed of acceptance of the inheritance
